The following represents an agreement between Canine Cohesion Behavior Services, LLC, and/or their employees, volunteers, independent contractors, representatives, agents, heirs, successors, assigns (hereafter referred to as Canine Cohesion) and the Client (undersigned). 

GENERAL POLICIES

1. GENERAL PAYMENT: Client agrees to pay Canine Cohesion all agreed upon amounts, in the time frame agreed upon. Selected time slots are not guaranteed until payment is received. Client further agrees to pay all costs and charges for special services requested and all veterinary costs for the pet during the time the pet is in the care of Canine Cohesion. Deposits are nonrefundable. No refunds are generally offered for cancellations, missed sessions, or incomplete packages, as deposits and fees cover administrative costs, preparation time, and the reservation of exclusive time slots. Exceptions may be considered, at Canine Cohesion’s discretion, in documented emergency circumstances. Any refund that is granted will be returned to the original method of payment, less processing fees, with no exceptions.

2. PAYMENTS & REFUNDS FOR  SESSIONS: Payment will be charged following each scheduled session. Because we are holding a spot for your dog each time you schedule, cancellations are not allowed and no refunds are generally offered. In extenuating circumstances outside of 24 hours, or in the case of a documented emergency, we may allow you to reschedule your consultation, but this is at the discretion of Canine Cohesion. If you purchase a bundle of prepaid sessions, however, we can allow you to make up your session. 

3. GENERAL SCHEDULING & RESCHEDULING & LATE FEES: There is a 24-hour reschedule policy for any pay-as-you-go sessions; sessions rescheduled or canceled with less than 24 hours advance notice will be charged a cancellation fee or forfeited if already paid. Exceptions to these policies may be made, but only if approved in advance by Canine Cohesion, and will only be considered in special cases for active program participants who are in regular communication with their trainer and our office. Clients who prepay for session bundles are able to make up missed sessions.

For dogs doing a Half Day morning shift that are not picked up by 12pm, the next available time to pick up will be 2pm and the client will incur a $15 charge. For Full Day Clients who are late picking up there dog there will be a $1.00 charge for every minute you are late.

4. RESULTS: The Client understands that success in Day Club is contingent on many factors that are beyond the control of Canine Cohesion such as the dog’s overall health, disposition, history and temperament, the Client’s actions and adherence to trainers’ suggestions, level of commitment, follow through, and participation, as well as other outstanding factors, including but not limited to environmental variables, other family members’ actions. Therefore, no specific results are guaranteed. 

6. MARKETING AND VIDEO RELEASE:  The Client grants Canine Cohesion full permission to use any video and/or written materials collected during training, for marketing or education uses. The Client may withdraw consent in writing for future use, but this will not apply to materials already created at that time.

LIABILITY WAIVER

In consideration of my taking part in training or other activities offered by Canine Cohesion, I, the Client, hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assigns as follows: 

1. RISK: I am fully aware that working with dogs and allowing my dog to be around and interact with other dogs carries an inherent level of risk, and I WAIVE RELEASE AND DISCHARGE Canine Cohesion from any and all liability, including but not limited to, liability arising from (1) ordinary negligence or fault, but does not include liability arising from gross negligence, willful misconduct, or intentional harm by Canine Cohesion or its representatives,  (2) training activities, boarding, transport, or care of the Client’s dog; (3) behavior of the Client’s dog; (4) the conduct of other participants, or (5) any other costs, expenses, or damages incurred as a result of my or my dog’s participation in these activities to include but not limited to any physical or property damage, medical bills, and or/legal bills.

2. SAFETY: I agree to adhere carefully to any and all management recommendations, to ensure the safety of both Canine Cohesion staff and others, both during and outside of training. I recognize that if my dog is exhibiting aggressive behavior, this cannot be cured and may only be mediated, and I ACCEPT FULL & SOLE RESPONSIBILITY for my dog’s behavior, notwithstanding any training or advice I may receive. Additionally, I understand that the health of my dog and the other dogs in the program is paramount and I will not willfully send my dog to Day Club if they are ill or showing symptoms of illness to include, but be limited to: diarrhea, coughing, vomiting, sneezing, lethargy, skin rashes, or parasitic and fungal infections or infestations. I certify that my pet/s are in good health and have not been ill with any communicable condition in the last 30 days.  I further certify that my pet/s have not harmed or shown aggressive or threatening behavior towards any person. All member dogs must be on a monthly flea and tick product.  Any pets who have fleas when arriving at Canine Cohesion will be treated with a Capstar tablet to kill the adult fleas and will be given a bath to remove the immature flea forms.  All these treatments will be provided at the Client’s expense. Client agrees and understands that there are certain risks for pets inherent with a cage free environment that include, but are not limited to, injury, illness from interactions with other dogs and Canine Cohesion and its Staff or volunteers will not be liable for any injuries or harm that might occur.  Client further agrees that Canine Cohesion, their staff/volunteers, will not be liable for any injuries or damages to their pet/s arising out of or from the boarding and care of my pet/s while under the care of Canine Cohesion provided that reasonable care and precautions are followed and release Canine Cohesion from any liability of any kind arising from my pet/s attendance at Canine Cohesion.   Client agrees that any problems that develop with their pet/s will be treated as deemed best by the Staff of Canine Cohesion, in their sole discretion, and that Client will assume full financial responsibility for any and all expenses involved.   Client understands and agrees to allow their pet/s to participate in playgroups with other dogs while at Canine Cohesion.  Client understands and agrees, for the welfare and safety of the dogs, NOT to walk around the building on either side to view their dog/s in the play areas without permission and an escort by Canine Cohesion Staff. And Client agrees that if by walking around without a staff escort causes a dog fight resulting in injury, Client agrees to incur all vet bills.

3. LIMITED LIABILITY: I INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE the entities or persons mentioned above, and agree that, notwithstanding any damages that I may incur, Canine Cohesion and its affiliates’ entire liability under this agreement, and my exclusive remedy, will be limited to the amount paid by the Client to Canine Cohesion for all services rendered up until the termination date.

4. JURISDICTION AND DISPUTE: If either party brings a proceeding arising out of this agreement, that proceeding may be brought only in:

(a) the United States District Court for the Western District of North Carolina, or, if there is no federal jurisdiction, the state courts of North Carolina sitting in Asheville; or

(b) the United States District Court for the District of South Carolina, or, if there is no federal jurisdiction, the state courts of South Carolina sitting in Greenville County;

depending on where the services were primarily performed.

The prevailing party shall be entitled to recover reasonable attorney’s fees and court costs.

CUSTOMER AUTHORIZATION FOR RECURRING CREDIT CARD CHARGES

I, the undersigned, hereby authorize Canine Cohesion Behavior Services, LLC (“Canine Cohesion”) to charge the credit card I have provided and placed on file for any and all scheduled services upon execution of said services. This authorization includes, but is not limited to, charges for appointments, reservations, consultations, packages, classes, or any other service requested and confirmed by me or by an authorized party on my behalf.

I acknowledge and agree to the following:

This authorization permits Canine Cohesion to charge my credit card automatically, without prior notification, for each scheduled service in accordance with the rates and terms agreed upon following services rendered or upon purchase of a group class or service package.
