This is a contract between Providence Animal Center (hereinafter called "kennel" and the pet owner(s) (hereinafter called "owner"):
1. This contract shall be ongoing and shall apply to the pet's initial visit to the kennel, as well as all subsequent visits at the kennel.
2. An owner who signs this contract certifies that he or she is authorized to act on behalf of the other non-signing owner(s).
3. The owner agrees to pay the rate for services in effect on the date that the pet is receiving the service.
4. The owner further agrees to pay all costs and charges for services that the owner may request.
5. By signing this contract and receiving services for the pet at the kennel, the owner certifies that all information given about the pet to the kennel is true and accurate to the best of the owner's knowledge, information and belief.
6. The kennel shall exercise reasonable care for the pet delivered by staff or volunteers of the kennel. However, it is expressly agreed to by and between the owner and the kennel that the liability to the kennel (including the kennel's owners, agents, employees and volunteers) for harm, injury, and/or death to the pet shall in no even exceed the lesser of the current chattel value of a pet of the same species or the sum off $200.00 per animal. Under no circumstances shall the kennel or trainer be liable for punitive or consequential damages, including, but not limited to, pain and suffering, loss of companionship, loss of services, and loss of breeding rights.
7. The owner specifically represents that the pet is free and clear of all liens and encumbrances.
8. The owner specifically represents to the kennel, to the best of the owner's knowledge, information and belief, that the pet has not been exposed to rabies or distemper within a thirty day period prior to receiving services.
9. The owner understands that pets can accidentally be injured. Cuts, scrapes, bruises, and bite wounds are a possible and not unexpected result of participation in group activities. The owner understands and agrees that the kennel, trainer and its staff and volunteers shall not be liable for any problems which develop.
10. The owner hereby releases the kennel of any liability of any kind arising from his or her pet's attendance and participation in services provided by the kennel.
11. All charges incurred by the owner shall be payable before services are rendered.
12. If the pet becomes ill, or if the state of the animal's health otherwise appears to require professional attention, the kennel, in its sole discretion, may require the owner engage the services of a veterinarian and the expense thereof shall be paid by the owner.
13. The owner gives permission for publication of photos or video taken of pet and/or owner by the kennel. The owner understands that the owner will not be paid any royalty or other compensation and hereby relinquishes any and all rights for payment if a photo or video of pet and/or owner is published in any form or medium.
14. Any controversy or claim arising out of, or relating to, this contract or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to the contract, shall be settled in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in any court having jurisdiction thereof. The arbitrator shall, as part of his or her award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney's fees of the prevailing party.
15. This contract contains the entire agreement between the parties. All terms and conditions of this contract shall be binding on the heirs, administrators, personal representatives and assigns of the owner and the kennel.
