Pet Care Agreement

I understand that Shooting Star Services LLC has relied upon my representation and warranty that my animal(s) is/are in good health, up to date on vaccinations, and has not injured or shown aggression or threatening behavior to any person, dog, or other animal in admitting my dog for services at their facility.

I understand that there are risks and benefits associated with individual training and group socialization of dogs. I agree that the benefits outweigh the risks and I accept the risk. I desire a socialized environment for my dog while attending services provided by Shooting Star Services LLC and while in their care. I understand that while the socialization and play is monitored by a Shooting Star Services LLC instructor to prevent injury, it is still possible that during the course of normal dog interactions my dog could become injured or injure others. Any non-serious injuries to my dog will be pointed out by staff upon pick-up. Owners will be promptly contacted by phone if the injury is deemed to be of a more serious nature. It is the discretion of Shooting Star Services, and its instructors, as to what constitutes a serious or non-serious injury.

I further understand that Shooting Star Services LLC, their owners, instructors, partners and volunteers, will not be liable, financially or otherwise, for any injuries to my dog, myself or any property of mine while my dog is participating in services provided by Shooting Star Services LLC. I hereby release Shooting Star Services LLC of any liability of any kind and nature, known or unknown, now expiring or later arriving.

I further understand and agree that while my pet is in the care and custody of Shooting Star Services LLC any problems with my dog, behavioral, medical or otherwise will be treated as deemed best by staff of Shooting Star Services LLC in their sole discretion, and in what they view as the best interest of the animal. I understand that I assume full financial responsibility and all liability for any and all expenses involved in regards to the behavior and health of my dog.

I further understand that I am solely responsible, financially or otherwise, for any injury, harm or damage caused by my dog while my dog is attending any services provided by Shooting Star Services LLC. I understand that attendance at a dog training class, or a private dog training lesson, is not without risk to myself, members of my family, my guests or my dog. I hereby release and forever discharge C. April Franz and Shooting Star Services LLC, as well as their instructors, partners, affiliates, agents and assigns, of and from all demands, actions, damages, and any liabilities, whatsoever, of every name and nature, known or unknown, now existing or later arising. You acknowledge and agree to take complete responsibility for the actions of your dog, yourself, and your guests, and at no time will any other person be liable for the acts of yourself, your dog, or your guests. If your dog is the cause of an injury, either to another person or to another dog, you agree to take full financial responsibility. By signing below, you agree to all terms contained herein.

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

I hereby agree to allow Shooting Star Services LLC to take photographs or use images of my pet in print form or otherwise for publication and /or promotion on social media.

I understand that if my dog is not picked up on time or prior to a date specified in a separate agreement, I hereby authorize Shooting Star Services LLC to take whatever action is deemed necessary for the continuing care of my dog. I will pay Shooting Star Services LLC the cost of any such continuing care upon demand by Shooting Star Services LLC. I also acknowledge that I will be fully responsible for all court fees, expenses, including attorney’s fees and associated costs, if I abandon my dog.

Fees for all services provided by Shooting Star Services LLC are non-refundable. All fees must be paid in full, by the client, no later than the end of the first session for public classes or private sessions. If client is requesting a refund due to circumstances beyond the control of Shooting Star Services LLC, the total amount of the fees paid will be provided as a credit on the client's account which may be used for products sold or services at a later date.

I further understand that this agreement is the entire agreement between the parties, and each party acknowledges that no representations have been made or relied upon which are not specifically set forth in this agreement. This agreement includes by incorporation any exhibits referenced in this Agreement. This agreement supersedes an agreements to the contrary made previously. This agreement is governed by the laws of the State of Minnesota.
