NATURE & NURTURE GROUP CLASS AGREEMENT AND WAIVER
WAGGING WITH WISDOM, LLC
This Nature & Nurture Agreement and Waiver (“Agreement”) is entered into by and between Wagging with Wisdom, LLC (“Trainer”) and the undersigned client (“Client”) as of the date of the first class session.
1. TRAINING FEES
1.1. Client agrees to pay Trainer a nonrefundable fee of twenty-five to three hundred dollars ($25–$300) for varying group training sessions (approximately sixty (60) to one hundred and twenty (120) minutes in duration), and twenty-five to three hundred dollars ($25–$300) for each follow-up curriculum.
OR
1.2. Client agrees to pay Trainer a nonrefundable fee not to exceed Three Thousand Dollars ($3,000) for a package of pre-paid training sessions. The fee is based on the scope of curriculum, length of stay, and total number of lessons. Payment is due in full before the initial class has commenced or by an alternative schedule mutually agreed upon in writing beforehand, by all parties.
1.3. All training sessions included in a package must be completed within three (3) months from the date of the first scheduled session. Unused sessions after this period shall be deemed forfeited and although will remain credited to your personal account, are not eligible for refund.
1.4. Client shall schedule all sessions using the Trainer’s designated online booking system or by referencing set class schedules.
2. SERVICES PROVIDED
2.1. Trainer agrees to provide dog training services, which may include private instruction, group classes, board and train, boarding, and other educational services. Training may occur at Client’s residence, Trainer’s facility, or in public locations as determined appropriate by the Trainer.
2.2. Trainer will make reasonable efforts to help Client achieve behavior and training goals; however, Client understands and acknowledges that no guarantees are made regarding the success of training or behavior modification.
2.3. Client agrees to follow all instructions provided by the Trainer and to actively participate in the training process, including daily practice and reinforcement of techniques as recommended.
3. MEDIA & PUBLICITY RELEASE
3.1. Client grants Trainer, its representatives, agents, employees, licensees, and assigns, the irrevocable right to photograph, film, and/or record themselves, their dog(s), and any individuals accompanying them during training sessions.
3.2. Client further authorizes use of such images or recordings for any lawful purpose, including but not limited to:
a. News media or press coverage;
b. Educational and instructional materials;
c. Marketing and promotional activities;
d. Inclusion in publications, websites, emails, and social media accounts associated with Wagging with Wisdom, LLC.
3.3. Client waives any right to inspect or approve the finished product and acknowledges that no compensation will be provided for the use of such materials.
4. VETERINARY REQUIREMENTS
4.1. Client represents that the dog(s) enrolled in training are current on the following vaccinations:
a. Rabies, in accordance with Connecticut State Law;
b. Distemper, Parvovirus, and Bordetella, as recommended by a licensed veterinarian.
4.2. Client further affirms that the dog is under the routine care of a licensed veterinarian and has been deemed medically healthy and fit for participation in dog training services.
5. CANCELLATION POLICY
5.1. Cancellations must be made with no less than twenty-four (24) hours’ notice. Failure to provide timely notice, or failure to attend a scheduled session, shall result in the session being forfeited without refund. In the case of prepaid packages, the session shall be deducted from the remaining balance.
5.2. Trainer reserves the right to cancel or reschedule sessions due to inclement weather, illness, or unforeseen emergencies. In such cases, the Client shall have the option to reschedule or receive a refund for the affected session if it was paid for in advance.
6. LIABILITY & INDEMNIFICATION
6.1. Client acknowledges that participation in dog training involves inherent risks, including but not limited to, injury to persons, property, or animals. Client agrees to assume all risks associated with training and to be financially responsible for any injury or damage caused by their dog(s).
6.2. Client agrees to indemnify, defend, and hold harmless Wagging with Wisdom, LLC, and its agents, employees, and representatives, from and against any and all claims, demands, losses, damages, or expenses (including attorneys’ fees) arising out of or resulting from the actions of Client or their dog(s) during or after the term of this Agreement.
6.3. Trainer reserves the right, in its sole discretion, to terminate group training services if:
a. The dog exhibits behavior deemed dangerous or unmanageable;
b. The dog poses a threat to other animals, people, or the Trainer; or
c. The Client breaches any provision of this Agreement.
In such event, all remaining sessions may be forfeited at Trainer’s discretion, and no refunds shall be provided.
7. ENTIRE AGREEMENT
7.1. This Agreement constitutes the entire understanding between the parties with respect to the subject matter herein and supersedes all prior agreements, representations, or understandings, whether oral or written.
7.2. No modification or amendment to this Agreement shall be valid unless in writing and signed by both parties.
7.3. Client acknowledges and agrees that Trainer has not made any guarantees, representations, or warranties, express or implied, regarding the results of training, including but not limited to the prevention of future behavioral issues or aggression.
