This agreement between the client (name, pet name, address, phone number listed below) and Wild Wags/Wild Wags Dog Training LLC (collectively known as "Provider') pertains to the following:
For good and valuable consideration, the parties agree as follows:
Offered services are:
Private Training: One on one training sessions with the dog trainer, dog, and owner.
Board & Train: The dog is boarded at the Wild Wags facility to receive one on one training during their stay. Board and Train stays are usually between 2-6 weeks long depending on the program and training issues being worked through. Board and training can also be offered in the dog trainers home on a case by case basis. Please consult management if you have further questions.
Day Training: The dog comes to the Wild Wags facility for the day to receive playtime, potty breaks, and one on one training. Similar to dog daycare but with training added in. Curriculum is based on the program purchased, owners needs, and dogs past history.
Group Training Classes: Classes with other training clients and their dogs held at the Wild Wags facility.
Overnight Boarding: The pet is boarded at the Wild Wags facility overnight. Includes playtime, potty breaks, and feeding. No training included.
Grooming/bathing: Grooming, bathing, brushing, nail clipping services.
Fees: Provider agrees to provide pet services and Client agrees to pay all dues for services to the Provider.
Training Services: Dog training includes obedience commands, manners training, games, training exercises, and problem behavior solutions and/or prevention, depending on the training program purchased.
Missed Training Session: Consistent training sessions are vital in making your dog’s training successful. Clients are allowed to reschedule sessions with reasonable notice. Refunds will not be given for missed sessions. Training Provider will provide alternate dates/times for rescheduled sessions. Frequent rescheduling or large gaps in missed training sessions (over 1 month) will result in forfeit of credits.
Removal from Training: Training Provider may remove the dog from the training program if the Training Provider believes that the dog poses a hazard or severe threat of any nature to the dog trainer, any other animal or person. Training Provider serves the right to terminate this Agreement at any time and Training Provider will refund the remaining balance of Client's unused sessions, if applicable, without any further liability or obligation. Upon termination in accordance with the foregoing.
Training Satisfaction Guarantee: Training Provider will make every reasonable effort to teach Client and Dog to perform the skills listed in the course curriculum, however, Training Provider does not make any guarantee of Dog's future performance or behavior as a result of providing training. It is the Client's duty to practice and reinforce the commands and behaviors with the dog. Client understands that without practicing and reinforcing behaviors, they will naturally become less reliable over time. Refunds will not be offered for any services.
Training Sessions Deposit: All training sessions must be paid for at the time of booking to confirm the booking.
Boarding Deposit: All boarding and board and train stays require a 50% deposit at time of booking.
Health/Medical:
- Client must provide proof of up to date DA2PP/DHLPP, Rabies, Bordetella.
- Canine Influenza is optional but is recommended.
- A negative fecal test is required within 90 days of boarding check ins (covering giardia, ova, parasites, etc)
- If a dog has a medical condition of any sort, we must be notified at the time of booking.
- All reasonable efforts will be made to administer oral medications during boarding stays.
- We do not perform any injections and recommend dogs that are diabetic or have a history of seizures, receive services in home or are boarded with their veterinarian.
- We will not board any pet that is in active heat or was recently in heat. Dogs with signs of active heat will be turned away.
- We will not board any pets that have open wounds, cuts, broken bones, or are wearing bandages or elizabethan-collars.
- Client agrees that if at any time Management deems that Dog needs veterinary care, Dog shall immediately be taken to the veterinarian and removed from active training sessions.
Medical Emergencies: Client acknowledges that despite our best effort to avoid accidents and illness, that such accidents and illnesses sometimes occur. Clients will be responsible for all veterinary expenses/charges if their dog must be seen and treated while in our care. Client will be contacted immediately if a veterinary visit is needed. In the event of a life-threatening situation, and representative cannot communicate with Owner, Owner directs that Wild Wags shall (choose one option from life threatening situation question).
Media Release: Client grants Provider the perpetual, non-exclusive right, license, privilege and authority to use Client's name and likeness, and Dog's name, breed, age, training progress, past behavior history and likeness to fix in any manner, medium, form or language, worldwide, in connection with the advertising and promotion of Provider in all media in any format now known or hereafter devised.
Abandonment: Owner understands and agrees that if his or her Dog is not picked up within seven (7) calendar days after the scheduled pickup date, the Dog shall be deemed to be abandoned and additional boarding charges shall apply, and in such event, Wild Wags shall gain legal custody and ownership of the Dog and retain the right to keep the Dog or place the Dog in a shelter, with animal control, or place the Dog in a new home with a new owner. Owner FULLY UNDERSTANDS AND AGREES THAT IF OWNER ABANDONS HIS OR HER DOG WITH WILD WAGS, OWNER MAY BE UNABLE TO RETRIEVE POSSESSION OF HIS OR HER DOG AND WILL HAVE NO RECOURSE AGAINST WILD WAGS.
Loss of ownership: Should the owner be unable to take possession of their pet after boarding, they should immediately notify the provider. All fees incurred up to that date will be owed, along with any fees incurred while the pet is placed with a local animal control, animal society, or private party for rehoming.
Liability: Provider agrees to exercise due and reasonable care of Dog. However, Provider is not liable for loss or damage from disease, death, escape, theft, fire and injury to person(s), other animals) or property by Dog during or after the term of this Agreement. Client agrees to pay resulting losses and damages suffered or incurred and to defend and indemnify Provider, its employees, interns, volunteers and agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.
This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties and expresses the entire agreement between Client and Provider regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or understandings have been made. Client acknowledges that Provider has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavior problems, or that the results of training will last for any particular amount of time.
Arbitration: In the event a dispute shall arise between the two parties to this Agreement, it is hereby agreed that the dispute shall be resolved and held in South Carolina. The arbitrator's decision shall be final and legally binding and judgment may be entered thereon. Each party will bear its own costs and expenses and attorney's fees.
This agreement may be amended only by a written instrument signed by both Client and Provider
